Terms of Service

1. Acceptance of Terms

By accessing or using Monetly ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. Monetly is operated by Monetly ("we", "our", "us").

2. Description of Service

Monetly is a Validation Operating System that produces deterministic BUILD, ITERATE, or KILL decisions based on measured user behavior. The Service includes:

• Creation and management of validation experiments (waitlist, fake door, payment intent modes)
• Deployment of test landing pages to collect behavioral signals
• Automated decision generation through our Decision Engine
• AI-powered landing page copy generation
• Metric tracking, A/B testing, and dashboard analytics

3. Account Registration

• You must provide a valid email address to create an account. Authentication is handled via magic link (passwordless).
• Each account creates one workspace. You are responsible for all activity under your account.
• You must be at least 18 years old or the age of majority in your jurisdiction to use the Service.
• You may not create multiple accounts to circumvent plan quotas.

4. Subscription Plans & Billing

• Monetly offers three subscription plans: Starter ($29/mo), Pro ($59/mo), and Advanced ($99/mo). Annual billing is available at a discount.
• Subscriptions are prepaid and automatically renew. You may cancel at any time; access continues until the end of the current billing period.
• Payment is processed by Polar (Merchant of Record) and/or Stripe. All billing disputes should be directed to the relevant payment provider.
• Upgrades take effect immediately with prorated billing. Downgrades take effect at the next billing cycle.
• Plan quotas (experiments per month, concurrent active experiments) are enforced per your subscription tier. Used experiment slots are not returned upon deletion.

5. Experiment Landing Pages

• Landing pages created through Monetly are for validation purposes only. They are designed to measure behavioral intent, not to conduct actual commerce.
• Payment intent mode does not process real payments. The simulated checkout form collects no financial information and executes no transactions.
• All test landing pages include noindex, nofollow meta tags and are not intended for search engine indexing.
• You are responsible for the content of your landing pages. You must not use the Service to promote illegal products, misleading claims, or content that violates applicable laws.

6. Decision Engine

• The Decision Engine produces BUILD, ITERATE, or KILL decisions based on measured behavioral data. Decisions require a minimum of 100 page views and MEDIUM confidence level.
• Experiments are automatically concluded after 30 days if minimum data thresholds are not met.
• Decisions are informational outputs based on behavioral signals. Monetly does not guarantee the commercial success or failure of any idea tested through the platform.
• Decision records and metric snapshots are immutable and cannot be edited or deleted.

7. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or to violate any laws
• Attempt to circumvent plan quotas, rate limits, or security measures
• Submit fake or automated traffic to manipulate experiment results
• Use landing pages to phish, scam, or collect sensitive personal information
• Reverse engineer, decompile, or attempt to extract the Decision Engine logic
• Resell or redistribute the Service without authorization

8. Intellectual Property

• Monetly retains all rights to the platform, Decision Engine, algorithms, and software.
• You retain ownership of your project data, experiment content, and landing page copy (including AI-generated copy once delivered).
• Skin templates and their visual assets are provided under license for use within the platform only.

9. Data & Privacy

Your use of the Service is also governed by our Privacy Policy. By using Monetly, you consent to the collection and use of data as described in that policy.

10. Service Availability

• We strive to maintain high availability but do not guarantee uninterrupted access to the Service.
• We may perform maintenance, updates, or modifications that temporarily affect availability.
• Running experiments will not be stopped due to maintenance. Monetly never terminates an active test prematurely (except at the 30-day hard stop).

11. Limitation of Liability

To the maximum extent permitted by law, Monetly and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes, but is not limited to, lost profits, lost data, or business interruption.

Monetly's total liability for any claim arising from the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

12. Termination

• You may cancel your subscription and delete your account at any time.
• We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or fail to pay subscription fees.
• Upon termination, your data will be retained for 30 days before permanent deletion, in accordance with our Privacy Policy.

13. Refund Policy

Monetly is a subscription-based digital service. All subscription payments are billed in advance and are non-refundable except in cases of duplicate charges, incorrect billing, or verified technical failure preventing access to the Service.

Refund requests must be submitted within 7 days of the charge date by contacting support@monetly.io.

If a subscription is cancelled, access to the Service remains active until the end of the current billing period. No partial or prorated refunds are issued for unused time.

14. Changes to Terms

We may modify these Terms at any time. Significant changes will be communicated via email or platform notification at least 14 days before taking effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.
